1. Who is the data controller?

The controller of your personal data while you use the Website is Publicon Services spółka z ograniczoną odpowiedzialnością, with its registered office in Wrocław, address: pl. 2. Basic information and definitions

2.1. What is the Privacy Policy?

The Privacy Policy is the document you are reading. It explains how personal data is processed and informs Users which of their personal data the Controller collects and how that data may be used.

2.2. Security

To protect personal data submitted through the Website, the Controller takes all reasonable steps to process personal data securely, in line with applicable law, and in a way that respects the User’s privacy.

2.3. What is the Website?

The Website is the site you are using, operated by the Controller at https://pointco.pl.

2.4. Who is the User?

A User is any person or entity that uses the Website.

2.5. What is personal data?

Personal data means any information relating to an identified or identifiable natural person — a person who can be identified, directly or indirectly. Identification may be based on an identifier such as a name, an identification number, location data, an online identifier, or one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that person.

2.6. What is the Service?

The Service is a free electronic service provided by the Controller on the Website, enabling Users to:

  1. browse, catalogue and search the information published on the Website;
  2. use the Newsletter;
  3. contact the Controller;
  4. follow links to the Controller’s profiles on other sites and platforms, such as linkedin.com, instagram.com, facebook.com, behance.net;
  5. use other services available on the Website.

2.7. What is data processing?

Data processing means any operation or set of operations performed on personal data, whether or not by automated means. This includes collecting, recording, organising, structuring, storing, adapting or altering, retrieving, consulting, using, disclosing by transmission, disseminating or otherwise making available, aligning or combining, restricting, erasing or destroying data.

2.8. What is a Device?

A Device is the tool the User uses to access the internet and the Website (for example a phone, tablet, laptop or desktop computer).

2.9. What are cookies?

Through the Website the Controller collects and processes information stored in cookies — small text files saved on the Device used to access the internet.

3. For what purposes is personal data processed?

The Controller may process the User’s personal data for the following purposes:

  1. presenting information about the Controller’s business (for example by displaying Website content);
  2. contacting the User (for example in response to an enquiry);
  3. enabling the User to post comments on the Website;
  4. sending the User information about Products and other marketing messages as part of the Newsletter Service, where the User has consented to receive them;
  5. enabling the User to use other services provided by the Controller;
  6. detecting spam;
  7. statistical measurement.

5. Proper use of the Website

The User must use the Website in accordance with accepted social norms and with respect for the copyright in the content made available. The User must not submit any unlawful content to the Controller.

If the User infringes copyright in content provided by the Controller, or publishes unlawful content, the User is liable for any resulting damage suffered by the Controller.

6. Which cookies does the Website use, and for what purposes?

Cookies are used for the following purposes:

  1. Marketing and advertising — for marketing, the Newsletter service or other services;
  2. Optimising use of the Website, including recognising the User’s Device and displaying the Website in a way that matches the User’s needs and preferences;
  3. Statistics and improvement — producing and processing statistics (for example visits, devices and behaviour) so the structure and content of the Website can be improved;
  4. Social features — the Controller and third-party services may use cookies to support social features, where applicable;
  5. Saving User preferences — adapting Website content to the User’s preferences.

7. Can the User control cookies?

The User may change cookie settings on their Device at any time, including the conditions for storing and accessing cookies. This can be done in the browser settings or in the configuration of the relevant service. Restricting or blocking cookies may affect some features of the Website.

8. Embedded content from other websites

The Controller may use third-party cookies for the following purposes:

  1. displaying multimedia on the Website that is loaded from an external service;
  2. collecting general, anonymous statistical data through analytics tools;
  3. using interactive features to promote the Website or extend its capabilities through social platforms (such as Facebook, LinkedIn, Instagram, Twitter / X, YouTube).

Third-party cookies are used when the Website embeds content (for example videos, images or articles) from other providers. Embedded content has the same effect as if the User visited that provider’s site directly. Those sites may collect information about the User, use cookies, add further tracking systems and monitor the User’s interaction with the embedded material, including if the User has an account and is logged in there.

The User should review the personal-data rules of the platforms whose content is embedded on the Website.

The Website also uses social plugins that operate on the principles described above. The Controller uses plugins from:

  1. Meta Platforms Ireland Limited (www.facebook.com, www.instagram.com, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland);
  2. LinkedIn Inc. (www.linkedin.com, LinkedIn Headquarters, 2029 Stierlin Ct. Ste. 200, Mountain View, CA 94043, USA);
  3. Adobe Systems Software Ireland Limited (https://www.behance.net/, 4-6 Riverwalk, Citywest Business Park, Dublin 24, Ireland);
  4. A Medium Corporation (https://medium.com/, 548 Market St., PMB 42061, San Francisco, CA 94104-5401, USA).

9. How long is User data stored?

The Controller processes personal data only for as long as necessary for the purpose for which it was collected (for example to reply to a contact-form enquiry, or for as long as the User uses the newsletter).

10. What rights do you have over your data?

The User may request information on how and for what purpose their personal data is processed.

The User may at any time request a file containing a complete export of their personal data held by the Controller, including all data they have provided. The User may also request erasure of all their personal data. The Controller may refuse erasure where there are legitimate grounds to keep the data, in particular where Polish or EU law requires it to be retained.

The User may at any time rectify inaccurate personal data or complete data that is incomplete. This does not apply to the username, which cannot be changed. The Controller reserves the right to review and update personal data.

The User has the right to lodge a complaint with the supervisory authority — the President of the Personal Data Protection Office (Prezes Urzędu Ochrony Danych Osobowych) — if they consider that their personal data is processed in breach of the GDPR or the Polish Personal Data Protection Act.

11. Where do we transfer data?

The Controller does not transfer personal data to third parties, except that it may disclose personal data to the extent necessary to entities authorised under Polish or EU law, or where a separate agreement with the data subject so provides.

The above does not apply to sharing personal data with the Controller’s employees and contractors insofar as this is necessary to provide the Services.

12. E-mail correspondence

If a person contacts the Controller by e-mail, the Controller may process their personal data in the manner and for the purposes set out in this Privacy Policy. In addition, personal data may be processed for purposes related to:

  1. performing a contract or contracts concluded with the Controller;
  2. presenting an offer;
  3. settling accounts between the parties. In that case, further details may also be set out in separate documents binding the parties (for example a data-processing agreement).

14. Complaints

The User may file a complaint about the technical operation of the Website or about data processing, including processing of the User’s data. The complaint should briefly describe the issue and state when it occurred. Complaints should be sent by e-mail to the address given in this Privacy Policy. The Controller will not consider a complaint filed more than 14 days after the irregularity was identified, a complaint that lacks the information needed to assess it, a complaint that repeats a matter already decided, or a message that is clearly spam.

15. Legal basis

This Privacy Policy has been prepared in accordance with:

  1. Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (the “GDPR”); and
  2. the Polish Personal Data Protection Act of 10 May 2018 (consolidated text, Journal of Laws 2018, item 1000, as amended).

16. Other tools used to analyse website traffic

As part of operating the Website, the Controller analyses traffic with Google Analytics, provided by Google Inc. (1600 Amphitheatre Parkway, Mountain View, CA 94043, United States). Google Analytics analyses use of the Website through cookies described in this Privacy Policy. Information collected while the Website is used (for example the referring URL, pages visited, browser type, language settings, operating system and screen resolution) is transmitted to and stored on Google Inc. servers. This information is used to analyse how the Website is used, to produce activity reports and to improve the Website. The Controller receives the results in anonymised form. The IP address transmitted by the User’s browser as part of Google Analytics is not combined by Google Inc. with other data.

Consent to website analytics may be withdrawn at any time by refusing cookies on the User’s Device. The User may also prevent the collection of the data described above, for example by installing the browser add-on at tools.google.com/dlpage/gaoptout.
